The idea of a colonial union emerged in 1754 after a conference in Albany, NY. It lapsed because each of the colonies had varied histories and characteristics engendered from them. That tendency colored the early history of the united states of America. Soon after Albany Britain and France fought the Seven Years War that brought the colonies in from the periphery. The call for Independence and the war that followed arose out of a British need to recoup revenue lost 1755-1763.
The Lee Resolution of 7 June 1776 that agreed to call for independence also empowered a committee to create the Articles of Confederation (AOC) and Perpetual Union. There were continual meetings to this effect, but again a sense for each colony to go its own way prevented agreement until November of 1777. With the Philadelphia under British occupancy, representatives signed the Articles on the 15th of that month in York, Pennsylvania. It required unanimous agreement to go into effect. Maryland, fearful off being subsumed by larger states held out until it become obvious that the French would withhold any loans unless the Articles were ratified. The Confederation governed the United States from 1 March 1781 until 4 March 1789

The AOC created a government that had difficulty collecting revenue. That narrative is constantly repeated. It was replaced by a federal system that still conceded power to the states. A flawed government does not erase its existence. Since the discussion centers around the most valid US horoscope, the first government qualifies as a candidate. We can agree that its structure made it difficult to conduct the business of a nation, but we should remember that the Constitutional Convention actually first convened to reform the AOC; we can reasonably expect that reform may have addressed its short comings.
Despite its drawbacks the government that effectively operated under the AOC accomplished quite a bit in its short life span:

  • Established its legitimacy as a sovereign state

  • Secured loans through other nations

  • Won a war against the then most potent empire

  • Negotiated a favorable peace agreement
    that included territory to the Mississippi River

  • Created the means to reform itself
    with minimal violence

Though the founders replaced the 1780s Confederation, these accomplishments proved critical. Some questioned the decentralization of the United States’ first government from the start. Each colony began at different times for different reasons; the AOC worked within their independent nature. They drew it up as they fought a war, desperate for funds (the signers of the Declaration might be hung for treason if they lost).

Logic also suggests the AOC. If the 1787 Constitution is a valid candidate, the first constitution should also make the list.
